    TERMS OF SERVICE

    These Terms of Service ("Terms") govern your access to and use of CampaignActivator (the "Service"), operated by Aligned Polarity LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

    1. ACCEPTANCE OF TERMS

    By creating an account, starting a free trial, or subscribing to the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

    2. DESCRIPTION OF SERVICE

    CampaignActivator is a campaign intelligence engine that helps marketing teams transform briefs and challenges into insight-led campaign blueprints, including strategy, social activation, media playbooks, and measurement frameworks. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

    3. ACCOUNT REGISTRATION

    To access the Service, you must create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

    4. SUBSCRIPTION AND BILLING

    The Service is offered on a subscription basis. By subscribing, you authorize Aligned Polarity LLC to charge your payment method on a recurring basis according to the plan you select. All fees are non-refundable except as required by law or as expressly stated in these Terms.

    Free Trial: We may offer a free trial period of 14 days. At the end of the trial, your payment method will be automatically charged the subscription fee unless you cancel before the trial ends.

    Beta Founder Pricing: Subscribers who join during the beta period at the $49/month rate will retain that rate for as long as their subscription remains active and uninterrupted. Cancellation of the subscription forfeits the locked-in beta founder rate.

    Price Changes: We may change subscription fees with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new fee.

    5. CANCELLATION AND REFUNDS

    You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods. If you cancel during a free trial, you will not be charged.

    6. INTELLECTUAL PROPERTY

    All content, frameworks, methodologies, software, and materials made available through the Service — including the Holistic Activation Method and any proprietary frameworks — are the exclusive property of Aligned Polarity LLC and are protected by intellectual property laws.

    User Content: You retain ownership of any briefs, data, or content you submit to the Service ("User Content"). By submitting User Content, you grant Aligned Polarity LLC a non-exclusive, worldwide, royalty-free license to use, process, and analyze your User Content solely for the purpose of providing and improving the Service.

    Output Ownership: Campaign blueprints, strategies, and other outputs generated by the Service for your account are licensed to you for your business use. You may not resell, redistribute, or repackage the outputs as a competing service.

    7. ACCEPTABLE USE

    You agree not to:

    • Use the Service for any unlawful purpose or in violation of any applicable laws
    • Attempt to reverse-engineer, decompile, or extract the underlying frameworks, prompts, or models
    • Use the Service to generate content that is defamatory, fraudulent, harassing, or violates third-party rights
    • Resell, sublicense, or share access to your account with parties outside your organization
    • Use automated tools to access the Service in a manner that exceeds reasonable use
    • Interfere with the security or operation of the Service

    8. CONFIDENTIALITY AND DATA

    We will treat your User Content as confidential and will not disclose it to third parties except as necessary to provide the Service or as required by law. Our handling of personal information is governed by our Privacy Policy.

    9. THIRD-PARTY SERVICES

    The Service may integrate with or rely on third-party tools, including AI model providers, payment processors, and analytics platforms. We are not responsible for the practices or content of third-party services. Your use of any third-party service is governed by that party's terms.

    10. DISCLAIMERS

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    Outputs generated by the Service are tools for strategic thinking and are not guaranteed to produce specific business outcomes. You are responsible for evaluating, validating, and applying the outputs in your work.

    11. LIMITATION OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIGNED POLARITY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

    Our total aggregate liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

    12. INDEMNIFICATION

    You agree to indemnify and hold harmless Aligned Polarity LLC, its officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

    13. TERMINATION

    We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other reasonable cause. Upon termination, your right to use the Service ceases immediately, and any outstanding fees become due.

    14. CHANGES TO TERMS

    We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

    15. GOVERNING LAW AND DISPUTES

    These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.
